What is an Uncontested Divorce?
Uncontested divorces (sometimes called "No-Contest Divorces") are the fastest, cheapest and least stressful way to divorce. Few divorce cases, including uncontested divorces, are completely free from disagreement. However, in an uncontested divorce, the disagreements are informally worked out by the parties prior to filing the actual divorce case with the Court, thus simplifying the divorce proceedings, lowering your costs, and keeping much of your personal information out of the proceedings and out of the public record.

Is an Uncontested Divorce Right for me?
For a divorce to be defined as uncontested, you and your spouse must agree on all applicable essential issues in advance of the actual divorce proceedings. Basically, this means that both of you sign a Marital Settlement Agreement that we prepare for you after thoroughly discussing all aspects of your divorce case with you and providing advice to you on the issues in your case as necessary. These issues include:
- Marital assets and property division (also called equitable division or property)
- Debt allocation
- Child custody and visitation (including a detailed Parenting Plan where required)
- Spousal support/Alimony (when appropriate) and child support
If you and your spouse can agree on these issues, you have an excellent chance of completing your uncontested divorce. Even if you and your spouse have a few outstanding minor disagreements or uncertainties, an uncontested divorce will likely work for you. We prepare all documents specifically for your particular divorce. Both parties will be required to sign a Marital Settlement Agreement that we custom prepare for you that documents your agreement with your spouse on all of the issues in your case.
We have found that over 90% of our clients seeking an uncontested divorce can, and ultimately do, terminate their marriage efficiently, inexpensively, and without the public intervention of a judge. Of course, part of retaining our services to handle your uncontested divorce means that we handle the preparation of all required legal paperwork for you and presentation of all that paperwork to the court. When minor children are involved, we also handle the complicated calculation of the child support obligations set forth by the Georgia laws in the form of the Child Support Worksheet and create a detailed Parenting Plan for your case.

Contested or Uncontested: You Decide
We strongly urge every person/couple having marital difficulties seek the advice of a marriage counselling professional. Once it is clear that divorce is inevitable, we also recommend that every couple first use all means possible to work out mutually acceptable terms on all issues. This can be done independently, or through arbitration or mediation. This will save time, money, and stress, and free you from a lengthy and expensive court battle.
Once basic decisions are made and the Marital Settlement Agreement has been signed by you and your spouse, we can file for the divorce and your case can be done in as little as about six weeks after the filing. No sheriff will come to serve papers on your spouse and all documents are completed in privacy and with dignity. Our uncontested divorce services are professional and fast, and our fees are low and flat:
- $425 for uncontested divorce with no minor children
- $850 for uncontested divorce with minor children
Because we begin to prepare all documents for your case as soon as possible, our low, flat fee must be paid in full to start your case. Court costs are not paid until all documents have been signed and we are ready to actually file your case and are paid to the Clerk of Superior Court of Cobb County by MONEY ORDER.
